
I have been a certified legal document preparer and bankruptcy petition preparer for over 20 years. I know this is a stressful time for my clients and my goal is to prepare your documents, not only in a timely and professional manner, but with empathy and care towards you, my client.
We will have 2 appointments to complete the bankruptcy preparation process. At the first appointment we will go through a questionnaire that I have, I will explain the bankruptcy worksheets that you will be filling out and returning to me, explain various other handouts, and finally, sign the contract to retain my services. My fee of $200 is paid at this time by either cash, check or money order. I will give you a receipt for your payment, as well as your packet containing the worksheets and copies of all documents signed at this first appointment.
You will complete the worksheets at your own pace at home; take a credit counseling class and obtain a certificate of completion (I will be giving you a list of approved providers and the cost for this class is nominal - about $20-$24); obtain updated credit reports; and gather up all paystubs or other proof of income for the preceding six months.
When you have completed the above you can either mail your completed packet to me or drop it by my office. I will review everything and email you with any questions or additional information needed. I will then type up your petition and schedules and email them to you for your review. Once approved by you, we will schedule our 2nd appointment for signing.
At this 2nd and final appointment, we will sign the petition and schedules, I will make the necessary copies, and you are then ready to file everything at the bankruptcy court. The filing fee is $338.
Upon filing your bankruptcy and receiving your case number, all creditor action against you will be stopped. You will then need to take a 2nd credit counseling class and file the certificate of completion with the court. You will be assigned to a Chapter 7 Trustee who will be overseeing your bankruptcy. You will work directly with this Trustee for the duration of your case. The Trustee will require documents from you, i.e. tax returns, bank statements, etc., and you will have a meeting before your Trustee known as a 341a hearing or Meeting of Creditors (virtual or in person). This is usually a very short meeting. The judge will then review your case and issue an Order of Discharge, typically about four months after you file, which will show that you have successfully completed your Chapter 7 bankruptcy and have discharged all debts that are dischargeable.
And now, congratulations! You have completed everything successfully and you can now get a fresh start to building up your good credit.
